We at Novobi are committed to protecting your privacy. This Privacy Policy describes how your personal information is collected, processed, stored, used, shared, and disposed of when you use our website, any of our products, or require our services. 

By using the Novobi website, any of our products, or accepting our services, you consent to the data practices described in this Statement. 

CHILDREN UNDER THIRTEEN

Our website, products, and services do not address anyone under 13-years-old, and Novobi does not knowingly collect personally identifiable information from children under thirteen years of age. If we discover that a child under 13 has provided us with personal information, we immediately delete this from our servers. If you are a parent or guardian and you become aware that your child has provided us with personal information, please contact us to take the necessary actions to remove your child’s information from our servers. 

COLLECTING YOUR PERSONAL INFORMATION

WHEN YOU USE OUR WEBSITE

When you browse our website, we do not collect any personal information about you unless we’re required or permitted for legal, compliance, or other lawful purposes or you voluntarily provide it to us when you:

  • Schedule an appointment using any of our Online Scheduling forms

However, you may be required to provide certain personal information when you elect to use our products or require our services.

Automatically Collected Information 

Novobi may automatically collect information about your computer hardware and software. This information can include:

This information is used for the operation of the service, to maintain the quality of service, and to provide general statistics regarding the use of the Novobi website. 

Use of Cookies 

The Novobi website may use “cookies” to help you personalize your online experience. A cookie is a text file placed on your hard disk by a web page server. Cookies cannot run programs or deliver viruses to your computer. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you. 

One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the web server that you have returned to a specific page. For example, if you completed an online scheduling form, a cookie helps Novobi recall your specific information on subsequent visits. The use of cookies simplifies the process of recording your personal information, such as name, addresses, and other information collected. When you return to the same Novobi website, the information you previously provided may be retrieved to easily use the Novobi features you customized. 

You can accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not fully experience the interactive features of Novobi website.

Novobi may keep track of the Novobi websites and pages our users visit to determine what Novobi products and services are the most popular. This data is used to deliver customized content and advertising within Novobi to customers whose behavior indicates that they are interested in a particular subject area.

When you request service from Novobi such as Consulting, ERP implementation, and, ERP support or maintenance, Novobi may collect personally identifiable information, such as your:

We do not collect any personal information about you unless you voluntarily provide it to us by

We will use your information for, but not limited to, communicating with you about services you have requested from us. We also may gather additional personal or non-personal information in the future as needed to complete the service you have requested. 

WHEN YOU USE OUR PRODUCTS

When you use any of Novobi’s products, Novobi may collect personally identifiable information. We do not collect any personal information about you unless you voluntarily provide it to us.

As of now, DIY installations of our products are not available. When you elect to purchase any of our products, Novobi’s assistance is needed to install our apps on your Odoo ERP. To purchase and use one of our apps, you must sign a service/product agreement with Novobi, and the information you provide and are collected will be protected as noted on this Privacy Policy.

To install our products on your Odoo ERP, we require the following information:

For Odoo Accounting App by Novobi, we collect:

  • First and Last Name 

  • Email Address 

  • Phone Number 

  • Employer 

  • Business/Company

  • Billing Information

  • Accounting information necessary to complete your service

For Odoo Retail Solution by Novobi, we collect:

  • First and Last Name 

  • Email Address 

  • Phone Number 

  • Employer 

  • Business/Company

  • Billing Information

  • eCommerce store name

PROCESSING, USING, AND STORING YOUR PERSONAL INFORMATION 

Novobi collects and uses your personal information to operate and deliver your requested products and services. We process and store the data collected using Novobi’s management system. This information is encrypted, and we follow a well-architecture framework in which all servers are located in private subnets and with only a load balancer in the public subnets. Administrators and tech leads must access the VPN to access the servers. All staff accessing sensitive information must have Norton Antivirus or other comparable antivirus installed on their computers as a company policy. The website back office is only accessible to staff with valid credentials. 

Novobi may also use your personally identifiable information to inform you of other products or services available from Novobi and its partners and affiliates. 

When installed on your Odoo ERP, some of our products allow you to collect data from your customers. Novobi only has access to this data during installation and when support is needed. The information is not collected or stored in Novobi’s database and not saved for Novobi’s personal use. For example, when you connect your Odoo Retail Solution to platforms such as Amazon, BigCommerce, Shopify, the app will access your seller account information like order management, inventory management, billing information, and other information needed to complete order fulfillment.

Novobi is not responsible for the data you collect from your customers, but during service, we will process this information in conformance with Data Protection Legislation. In particular, Novobi commits to:

  • Only process the data when and as instructed by you, and to perform services you have requested unless required by law to do so, in which case Novobi will provide prior notice to you unless the law forbids it ;

  • Ensure that all persons within Novobi authorized to process your data have committed themselves to confidentiality ;

  • Implement and maintain appropriate technical and organizational measures to protect your data against unauthorized or unlawful processing and accidental loss, destruction, damage, theft, alteration, or disclosure ;

  • Forward promptly to you any Data Protection request that was submitted to Novobi about your database ;

  • Notify you promptly upon becoming aware of and confirming any accidental, unauthorized, or unlawful processing of, disclosure of, or access to your data ;

  • Notify you if the processing instructions infringe applicable Data Protection Legislation, in the opinion of Novobi;

  • Make available to you all information necessary to demonstrate compliance with the Data Protection Legislation, allow for and contribute reasonably to audits, including inspections, conducted or mandated by you,

  • Permanently delete all copies of your database in possession of Novobi, or return such data, at your choice, upon the termination of your service agreement with Novobi, subject to the delays specified in the agreement.

We will only retain such data and databases as long as necessary for collecting it, as laid out in this policy, including any legal retention period, or as long as necessary to carry out a legitimate and reasonable promotion of our products and services. 

DATA SECURITY

Novobi secures your personal information from unauthorized access, use, or disclosure. Novobi uses SSL Protocol and encrypts Personally Identifiable Information at rest for this purpose. We also store your data on servers provided by third-party hosting vendors we have contracted. 

We strive to take appropriate security measures to protect against unauthorized access to or alteration of your personal information. Unfortunately, no data transmission over the Internet or any wireless network can be 100% secure. As a result, while we strive to protect your personal information, you acknowledge that:

  • there are security and privacy limitations inherent to the Internet which are beyond our control; 

  • and security, integrity, and privacy of all information and data exchanged between you and us through this Site cannot be guaranteed. 

SHARING INFORMATION WITH THIRD-PARTIES

Novobi does not sell, rent or lease its customer lists to third parties. 

Novobi may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personally identifiable information (email, name, address, telephone number) is transferred to a third party. Novobi may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange deliveries. All such third parties are prohibited from using your personal information except to provide these services to Novobi, and they are required to maintain the confidentiality of your data. 

We also share your business information, together with details of the representative of the business (name, email, Phone) with Odoo S.A. if you sign up for the Odoo Retail Solution. 

Novobi may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to

  • Conform to the edicts of the law or comply with legal process served on Novobi or the Site such as responding to responding to a subpoena, search warrant, or other lawful requests for information we receive

  • Protect and defend the rights or property of Novobi; or

  • Act under exigent circumstances to protect the personal safety of users of Novobi or the public. 

When requested under Data Protection Laws, we will collect your prior consent before processing your data for these purposes.

Under California Civil Code, if you are a California resident, you may email [email protected] to request your personal information and request your information not be shared with third-parties for their direct marketing purposes.

You have the right to access the personal information we hold about you and ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below. We will not discriminate against you for the exercise of these rights. If you request to delete your account, you can contact us to request a new account. We currently do not offer account management on our website or any online portals, and reinstating or recovering your deleted account is not possible. 

Additionally, suppose you are a European resident. In that case, we note that we are processing your information to fulfill contracts and agreements we might have with you or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information may  be transferred outside Europe, including Canada, Vietnam, the Philippines, and the United States. 

Novobi only transfers your personal information to other countries in the usual course of our business, where we can be sure that we can protect your privacy and your rights. For example, the third-party is located in a country which the EU has deemed to have adequate data protection laws in place, where that third party is certified on the EU-US Privacy Shield or where we have a contract in place with that third-party which includes the European Commission’s standard data protection clauses.

You may review your Data Subject Rights under the EU legislation’s General Data Protection Regulation (GDPR). Each Data Subject has eight rights. These are:

The right to be informed: this means anyone processing your data must clarify what they are processing, why, and who else the data may be passed to.

  • The right of access: this is your right to see what data is held about you by a Data Controller.

  • The right to rectification: the right to have your data corrected or amended if what is held is incorrect in some way.

  • The right to erasure: under certain circumstances, you can ask for your personal data to be deleted. This is also called ‘the Right to be Forgotten’. This would apply if the personal data is no longer required for the purposes it was collected for, or your consent for processing that data has been withdrawn, or the personal data has been unlawfully processed.

  • The right to restrict processing: this gives the Data Subject the right to ask for a temporary halt to processing personal data, such as when a dispute or legal case has to be concluded, or the data is being corrected.

  • The right to data portability: a Data Subject has the right to ask for any data supplied directly to the Data Controller by them to be provided in a structured, commonly used, and machine-readable format.

  • The right to object: the Data Subject has the right to object to the further processing of their data which is inconsistent with the primary purpose for which it was collected, including profiling, automation, and direct marketing.

  • Rights in relation to automated decision making and profiling: Data Subjects have the right not to be subject to a decision based solely on automated processing.

RIGHT TO DELETION

Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will: 

  • Delete your personal information from our records; and 

  • Direct any service providers to delete your personal information from their records. 

Please note that we may not be able to comply with requests to delete your personal information if it is necessary to: 

  • Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted under federal law, provide a good or service requested by you or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us; 

  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity; 

  • Debug to identify and repair errors that impair existing intended functionality; 

  • Exercise free speech, ensure the right of another consumer to exercise their right of free speech, or exercise another right provided for by law; 

  • Comply with the California Electronic Communications Privacy Act; 

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent; 

  • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us; 

  • Comply with an existing legal obligation; or 

  • Otherwise, use your personal information internally in a lawful manner compatible with the context in which you provided the information. 

OPT-OUT OF DISCLOSURE OF PERSONAL INFORMATION OF THIRD-PARTIES 

In connection with any personal information we may disclose to a third party for a business purpose; you have the right to know the categories of personal information that we disclosed about you for a business purpose.   

You have the right under the California Consumer Privacy Act of 2018 (CCPA) and certain other privacy and data protection laws, as applicable, to opt out of the disclosure of your personal information. Suppose you exercise your right to opt out of the disclosure of your personal information. In that case, we will refrain from disclosing your personal information unless you subsequently provide express authorization to disclose your personal information.

From time to time, Novobi may contact you via email to provide announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. To improve our products and services, we may receive a notification when you open an email from Novobi or click on a link therein. 

Suppose you would like to stop receiving marketing or promotional communications via email from Novobi. In that case, you may opt-out of such communications by clicking on the UNSUBSCRIBE button in the email, replying STOP to the email, or emailing us at [email protected]

Novobi reserves the right to change this Privacy Policy from time to time. We may notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our website, and/or by updating any privacy information. Your continued use of the website, products and services available after such modifications will constitute your:
